www.gaminghero.net (the “Website”) is a website owned by Traffi.cx, to which its Privacy Policy therefore applies.

At Traffi.cx (as defined below), we process personal data about our customers and visitors to our websites (“you”). We strive to treat your personal data with care, to keep it secure and to comply with data protection laws. 

Traffi.cx is engaged in performance marketing and online lead generation and is headquartered in Malta with offices in several other countries.

You may only use and access our websites and services if you are over 18 years of age (or the minimum age applicable under the laws of the relevant jurisdiction, whichever is higher). 

HOW THIS POLICY WORKS.

The purpose of this policy is to explain when, why and how we process information that may relate to you (“personal data”). It also contains important information about your legal rights. This policy does not affect the terms of any contract you may have with us or any rights you may have under data protection laws.

WHO IS RESPONSIBLE FOR THE MAINTENANCE OF YOUR PERSONAL DATA?

The Data Controller is the entity that determines the means and purposes of the processing of personal data. 

You should be aware that while we are primarily responsible for maintaining your personal data, this information may be stored in databases to which other companies have access. When accessing your personal information, all companies will adhere to the standards set forth in this policy.

For example, we may collect other information when you participate in some of our offers or contests, when you use the Forum when we make it available, when you choose to contact us, or when you connect with us through social media or other third party applications (your social media provider or third party application may allow you to share information with us – if you choose to do so, you will generally be notified by your social media provider as to what information will be shared)

We do not collect personal information from individuals under the age of 18 (or under the age at which they have the right to consent under the laws of their jurisdiction, whichever is greater). If personal information has been collected from minors without our knowledge, please contact us at the address provided.

WHAT DO WE USE YOUR PERSONAL DATA FOR AND WHEN DO WE PROCESS YOUR PERSONAL DATA?

The Data Controller collects information directly from you when you use our services or visit our websites. 

We use your personal data for the following purposes:

  • Creating and managing your account and subscriptions. 
  • Provide, maintain, improve and personalize the services to which you subscribe
  • Comply with or exercise our legal obligations or rights
  • Sending you service information about your account and subscriptions, for example, to notify you of changes to the services to which you are subscribed
  • Sending you direct marketing messages and other types of promotional messages, e.g., via email, SMS, social media (e.g., on Facebook, Telegram, Whatsapp) about products or services of Trafficx Ltd and its advertising partners (as defined in Section 4 below), provided that you have given your consent. You may opt out at any time. See also Section 6 for more information about direct marketing.
  • To improve our marketing communications, we may use technology similar to cookies to confirm whether you have opened a marketing email or clicked on a link in the email
  • Communicate with you in other ways and respond to your inquiries, for example, through our customer support services 
  • Analyze information in our systems and databases to improve the way we operate our business and websites according to user preferences and to provide better service and user experience
  • Personalize, customize, target and improve the content you receive based on your preferences and the data we collect from you
  • Improve and target the advertising and content you receive from us and our advertising partners

  • Register you for a chat forum or community, if we provide them, where you can post comments.

WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

We work with many third parties to help us manage our business and provide services. These third parties may need access to your personal data from time to time: 

  • mailing and SMS providers who process personal data on our behalf as data processors 
  • plug-in providers or hosts that process personal data on our behalf as data processors
  • chatbot platforms and providers that process personal data as data processors on our behalf
  • other service providers (e.g., cloud service providers, hosting providers, authentication providers, etc.) that process personal data on our behalf as data processors
  • service providers for analytics and cookies (and similar technologies) that also process personal data for their own purposes as data controllers.   • advertising partners (e.g., advertising networks such as third-party ad servers, advertising agencies, advertising technology providers and market research companies, affiliate link partners) who also process personal data for their own purposes as data controllers. These are identified through our cookie consent management platform. Please read their privacy policies to find out how they collect and process your personal data
  • third-party applications or social media services (e.g. Facebook or Telegram Messenger, Whatsapp Messaging) that also process personal data for their own purposes as data controllers. These may be integrated into the Website in various ways (for example, we may integrate social media messages or chatbots on our Website, social media accounts or groups to allow you to interact with us and the Website or otherwise send you various communications). As a result, we may collect some of your personal information or the social media provider or third-party application may receive some of your information (more on this in Section 1 above)
  • Trafficx Ltd subsidiaries located inside or outside EU/EEA for internal administrative and marketing purposes. The transfer of personal data is made in accordance with Trafficx Ltd’s data transfer agreements and on the basis of our legitimate interest and your consent when such data is transferred to another subsidiary of Trafficx Ltd Group for its own marketing purposes.
  • law enforcement and data protection authorities if we are required to disclose in order to comply with a legal obligation or to protect our interests or security.
  • in the event that we sell, buy or restructure a business or assets, or if our assets are acquired by a third party, including potential sellers or buyers.

INTERNATIONAL DATA TRANSFERS

International transfers means transfers of personal data to a country outside the US.

We may provide access to your personal data to third parties who may be located outside the US. In such cases, we will ensure that the transfer of your personal data is in compliance with applicable data protection laws and, in particular, that appropriate safeguards, such as standard contractual clauses approved by the US Commission, are in place.

We may also share your personal data if we receive a legal or regulatory request from a foreign law enforcement agency outside the US.  

We will always take steps to ensure that any international transfer of information is handled in a way that protects your rights and interests. Any requests for information that we receive from law enforcement or regulatory authorities will be carefully considered before any personal data is disclosed.

DIRECT MARKETING

We may use your personal data to send you direct marketing communications about products and services offered by Trafficx and its advertising partners, such as online casino, sports betting and financial services. This may take the form of emails, SMS, Whatsapp, Facebook or Telegram messenger or targeted online advertising.  

The use and processing of your personal data for the purpose of sending electronic marketing messages is based on your consent to receive such messages. Where permitted by law, this will be on the basis of our legitimate interest. Where we have received your consent, we will use third parties to help us process your personal data for marketing purposes.

After we have received your consent to send you electronic marketing messages, you can opt-out from receiving further electronic marketing messages at any time. You may use the opt-out link provided in all electronic direct marketing communications, or you may contact us.

We will endeavor to limit direct marketing to a reasonable and appropriate level and to send you communications that we believe will be of interest or relevance to you based on the information we have about you.  

HOW LONG DO WE KEEP YOUR PERSONAL DATA?

We will retain your personal data for as long as is necessary.

In certain circumstances, we may retain your personal data for a specified period of time, for example, to comply with legal, tax or accounting requirements or for as long as we have a contractual obligation with you (for example, if you are a registered user).

In connection with our marketing and targeting activities, we will continue to collect and process your data until you withdraw your consent to its collection.

We have a policy for the retention of personal data entrusted to us. When your personal data is no longer needed, we will ensure that it is either securely deleted or anonymized.

Access You may ask us to do the following:

  • Confirm whether we are processing your personal data;
  • Provide you with a copy of that data;
  • Provide you with more information about your personal data, such as what data we have, what we use it for, who we share it with, whether we share it outside the EU and how we protect it, how long we keep it, what your rights are, how you can make a complaint, where we got your data, and whether we have used automated decision making or profiling, to the extent that this information has not already been disclosed to you in this policy. 

You may ask us to correct inaccurate personal data. 

We may attempt to verify the accuracy of the data before correcting it.

Deletion You may ask us to delete your personal data, but only if:

  • it is no longer needed for the purposes for which it was collected; or
  • you have withdrawn your consent (if the processing was based on consent); or
  • after a successful objection procedure (see “Objection” below); or
  • the data has been processed unlawfully; or
  • in order to comply with our legal obligations. 
  • We are not obliged to comply with your request to delete your personal data if the processing of your personal data is necessary 
  • for compliance with a legal obligation; or
  • For the establishment, exercise or defense of legal claims.
  • There are certain other circumstances in which we are not required to comply with your request for erasure, although these two circumstances are the most likely circumstances in which we would deny that request

Restriction You may ask us to restrict (i.e., store but not use) your personal information, but only if:

  • its accuracy is contested (see rectification) so that we can verify its accuracy, or
  • the processing is unlawful but you do not want it to be erased, or
  • the data is no longer needed for the purposes for which it was collected, but we still need it to establish, exercise or defend legal claims, or
  • You have exercised your right to object and the examination of the compelling reasons is still pending.

We may continue to use your personal data after a request for restriction if:

  • you have given us your consent; or
  • to establish, exercise or defend legal claims, or
  • To protect the rights of another natural or legal person. 
  • Portability You may request that we provide you with your personal data in a structured, commonly used and machine-readable format, or you may request that it be “ported” directly to another data controller, but in any case only if:
  • the processing is based on your consent or on the performance of a contract with you; and
  • the processing is carried out with the help of automated procedures. 

You may object to the processing of your personal data based on our “legitimate interests” if you consider that your fundamental rights and freedoms outweigh our legitimate interests. 

If applicable, we can demonstrate that we have compelling legitimate interests that outweigh your rights and freedoms. 

International Data Transfers You may ask to receive a copy of, or a reference to, the safeguards under which your personal data is transferred outside the US.

We may redact data transfer agreements or related documents (i.e., obscure certain information contained therein) if required for commercial reasons. 

You have the right to lodge a complaint about our processing of your personal data with the relevant local supervisory authority.

We encourage you to first try to resolve any issues with us, although you have the right to contact your supervisory authority at any time.
